""The suspect opened fire as she was handing the children out the window to our officers," Callagy said. "SWAT officers used heroic efforts to make sure those kids got out of there safe." Anthony Peterson, a real estate agent who was watching with co-workers from their nearby office, said, "I saw two kids. They were babies. ... (Officers) brought them over to some cars in safety and checked them over. They seemed fine physically." He and Antrobus said police had fired about a dozen shots at the suspected intruder. The woman was wounded in the gunfire, possibly by a bullet shot through the wall into her barricaded sanctuary, Callagy said. She was taken to Stanford Hospital, where she died."

Sad. It's a tragedy that two young children, a one year old and a three year old have lost their mother. There are too many guns on the streets of America.

Same thing happened here in Vermont twice in the last 2 days.

As times get tight and people get desperate, there will be more of these. It is awful.

@hardaway After reading the story and watching the video clip It appears as this guy is an average career criminal / bad guy. I don't think the economy really affects people like this other than if you and I have less extra things, they would have less to steal.

i think we need much harsher penalties for people caught with illegal guns. Right now criminals get a slap on the wrist. Earlier this year a convicted felon with a previous illegal gun conviction paralyzed a 10 year old boy less than a mile from my house. If someone's willing to use an illegal gun and gets off with a 6 month stint in prison, they'll be back out and use another one again. We need much harsher gun penalties in this country.
- Thomas Hawk
criminals should get at least 10-15 years in prison for using a gun, not the slap on the wrist that they get now. The penalty has to be so great that they consider using less deadly weapons when committing crimes. Criminals who would use a gun in a crime are some of the most dangerous of all and need to be separated from society. It's so sad that these two babies will never really know the heroic mother who gave birth to them and then saved their lives.

@Thomas Hawk don't see how "guns on the street of america" is the issue either. I'm friends with a couple and the wife went for a walk with her female neighbor.... after the walk they both went to their homes. Neighbor lady went into her house and there was a thief in her home. He was on drugs and had a knife. He stabbed her and she tried to get away. Husband of the couple we know heard the lady scream hysterically, He grabbed a shotgun. Long story short he stopped the druggie and held for police.
- Adam Nollmeyer
Adam, certainly there are many, many crimes that are committed with knives and other weapons. But in general these weapons cause far less damage. The issue of stray bullets alone killing innocent bystanders (or paralyzing the 10 year old less than a mile from my home as was recently the case) are evidence of this. I have no problem with *legal* guns as in the shotgun that you mention, but *illegal* guns (e.g. a felon in possession of a gun) ought to receive much more prison time than they do today.
- Thomas Hawk
I've said it before and I'll say it again, "Guns cause crime like flies cause Trash" ... The issue is not the method, but the crime. Making MORE LAWS is not going to change anything, because we know criminals aren't really into laws. Adding more time or a heavier weight to a crime because of a firearm still is not the answer, because like anything else it can be lowered in court. The problem is the actions, not the method If somone was knived instead of shot is it fair to get less time?
- Adam Nollmeyer
there are too many illegal guns on the streets of America today. People are killed every week in Oakland by them.
- Thomas Hawk
I believe that murder by either gun or knife ought to get the person convicted of that crime at minimum life in prison without the possibility of parole. But for lesser crimes, or simply say a felon possessing a gun when the police pull him over and see it in his car, these individuals should get much more jail time than they do.
- Thomas Hawk
The `guns don`t kill people - people kill people` mantra gets awful tired after a while. The fact is that hand guns and automatic weapons are people killing machines.
- Brian Sullivan
Alameda Superior Court Judge Leo Dorado let Jared Adams out of prison after only a 6 month sentence -- even though Adams had several previous convictions including an illegal gun conviction. Adams then proceeded to paralyze a 10 year old with an illegal gun. We need strict mandatory 15 year sentences for illegal gun convictions. This would have kept Adams in prison and the 10 year old,...

Right and swimming pools should be outlawed because they are dangerous, instead of people being responsible and watching kids around water. @TH, I whole hearted AGREE that slap on the wrists like you mention are majority wrong. A felon w/ a gun and those on probation is *already* illegal so IDK how making it "more illegal" is going to help. It's a legal system problem IMO. @BS, might be overused but it's still true.
- Adam Nollmeyer
While it's debatable whether guns foster crime, it's less debatable that guns make crimes more deadly.
- Kevin Fox
Adam, if it's a legal system problem then you create stricter laws to get around judges like Leo Dorado. By creating laws that require mandatory 15 year sentences for individuals caught possessing an illegal gun, you'd force judges like Dorado to follow the law and lock people up for 15 years. It's not making it "more illegal," it's instituting harsh mandatory penalties for any illegal gun possession. No one who would possess an illegal gun belongs on the streets of America.

Tough choices are made at the point of sale and even tougher choices are made at the point in which one becomes aware that his or her life is hanging in the balance. If I have to defend myself, in a life threatening situation, I'd like to have the ability to do so. For those who would rather not own firearms; I commend you on your bravery.
- Christopher Harley
Don't agree with the anti-gun tenor here in the comments. Agree with Acme on the gun issue (while despising the "druggie" language, but that's another program). Had this woman had a gun, things might have ended differently. I think Thomas might be on the right track - I have very little trouble, generally speaking, with background checks or gun registration..... although I have a healthy skepticism it would do much to reduce gun violence.
- Anthony Citrano
They haven't released the name of this vermin who was killed in today's San Mateo shooting. But it will not surprise me when they do if he'd had previous gun convictions. And because of his actions today a one year old and a three year old get to grow up without their mother. Harsher and stricter laws with mandatory sentencing are definitely needed. I'm tired of seeing people die by guns every single week in Oakland.
- Thomas Hawk
unless you create new laws, Judges like Leo Dorado will continue letting career criminals slide with 6 month sentences and more innocent people will continue to die by guns.
- Thomas Hawk
Anthony, re: Druggie Language...well the guy who broke into friends neighbors house... He was hopped MULTIPLE illegal drugs, so in my book he's a druggie. (and FF limits characters to type more info) Why couldn't we just have tougher penalties (or enforce what we have) for the crimes themselves wouldn't that work as good / better than trial by method.
- Adam Nollmeyer
The current laws are not good enough because they allow significant judicial latitude in sentencing. They give judges too much flexibility. A new law requiring mandatory 15 year sentences for illegal gun possession would do the trick.
- Thomas Hawk
New thought, how about we ban judges like like Leo Dorado. I'm serious... bad judges suck
- Adam Nollmeyer
project exile might be another good place to start but the problem is you can't get the Mayors in cities like Oakland (Ron Dellums) to advocate it. http://en.wikipedia.org/wiki...
- Thomas Hawk
What I'm getting at, Acme, is that in much the same way the gun isn't the problem, the drugs aren't the problem either, and I think the "druggie" language distracts from the core issue. How many gun deaths can be attributed to alcohol, for example, far and away this nation's most dangerous drug? I don't want to turn it into a drug debate, I was just saying it's not relevant and the language implies it is.
- Anthony Citrano
sad story, this is only the beginning for the rise in violent crimes across the country. some big cities are going to be hit the hardest and erase the once held titles of being some of the safest in the nation
