"Let me put this out there. the right of Habius Corpus is simply the right to hear charges read against you. The supreme court affirmed this right to the detainees...3 times (this most recent ruling being the last). It doesn't let anybody off the hook or prevent people like KSM from being tried...all it does is allow for anybody in gitmo to request a hearing to have his charges read to him and allows him council. The second ruling affirms the rights of americans in foregin lands to have this right (specifically stemming from the Bush position that Iraqi legal system is fine and american's arrested over there have no right of appeal to the state department).
