"Set-up for my Homer Simpson shot. I used a flash attached to the camera's flashcube slot to force the camera to use the smallest aperture in order to keep everything in focus. The flash was bounced off the "ceiling" and contributed to about half of the lighting. The rest of the light came from fluorescent bulbs overhead. For the Homer reflection in the mirror, I used Groundskeeper Willie's body and Homer's half brother's head. I had to do quite a bit of filing to get them fit together."

Especially if they are using it for personal or non-commercial use -- I have no problem with that personally. But just because I'm pretty lenient with how people use my work, doesn't mean that there are not repercussions when people do rip work off the web -- especially when it's used for commercial use. It was interesting to hear yesterday from photographer Christopher Boffoli who has done a lot of freelance work lately for the West Seattle Blog. Boffoli wrote me and told me about a situation where a Seattle based Realtor, Laura Miller with Catalyst Commercial Partners, used an unauthorized photo of his for a real estate listing (photo above) of hers and ended up having to pay him a $1,000 small claims court judgment over it. I'll let Boffoli tell part of the story in the email that he sent to me:...
"A recent user whose account was deleted by Flickr for 'voyeur content' challenged Flickr to define voyeurism and candid imagery in the famous image above by Robert Doisineau. Not surprisingly, Flickr closed the account in their characteristic silencing tactics. Flickr still refuses to acknowledge what the difference is and is happy to delete candid photos at will after just one complaint."

This is, indeed, stupid behaviour from Flickr (although it may be on legal advice). However, can we please stop using "fascist" as shorthand for "anything I don't like"? Real fascists run gas chambers, not photo sharing sites.

Lou, i don't think it's Yahoo actually. I think the Flickr culture has always encouraged censors to act pretty aggressively from the very beginning. A lot of the censorship staff has been with Flickr for quite a while. I think the Flickr founders always probably envisioned a pretty censored experience.
