The problem with predicting performance increase over time in computing is two fold. Firstly, despite all appearances, Moore's Law isn't an actual law, it's just an observation that has been taken way too seriously. The fact that the definition of what it actually is has changed several times since the number of transistors doubling every 18 months of the original statement proves it's not a law. There is nothing that says that this must continue to happen. Secondly, as we get faster, and components get smaller, we are rapidly approaching the physical limits of the universe as we understand them. Getting too far below the new 22nm processes favoured by the chip manufacturers will result in electrons not behaving quite the way we expect them to. We need a breakthrough in technology, whether it be quantum computing or something else, in order to keep performance increasing as we expect it to. That said, Exaflop performance may still be do-able with current technology.

Regardless of how one feels about copyright, it's hard to defend the movie producers over this one. They made money (well, by most standards, Hollywood accounting standards are different), and could presumably easily afford the royalty payment, but are trying to get out of doing so (after having agreed to do so) on a technicality.

So fish can use tools now. Can we officially either declare it dead as a measure of intelligence? Or even that intelligence is more pervasive in the animal kingdfom than we thought. At least until we find it in plants.

The chief question is about the level of service you're willing to provide. If you have a large fleet and limited resources, you're going to want to tie things down. If you have a small fleet and a relatively savvy client base, you may be willing to allow more freedom.
