It's interesting that, while you mention Chris Messina by name, and link to his "store front," nowhere do you link to his original Twitter post, nor make an attempt to discover how he came by that Apple notice, what command he used. Instead, the Macgasm being advertised here is crosslinked to your own Twitter RT, with a bit.ly'd pointer back to Macgasm, and another to this auto-regurgitated FriendFeed repost (which in turn is reprinted there, as this will be). Is this what's known as way-new journalism?

Oh, and if you want to see the kext in a list in the terminal: kextfind -loaded -bundle-id -i -s 'com.apple.' -print | more I wouldn't recommend messing with it though, especially if you had no idea how to get them listed in the first place.

Carmen I think it is Chuckie. A bunch of these character types hang out around the Mann's theater on Hollywood Bvld. I remember a photographer doing incredibly dark portraits of some of these costumed characters but have lost the site.

I think the commercial use by MyxerTones.com is also wrong, but I don't blame Flickr. I don't think it is their job to be the copyright police. If MyxerTones violates licenses and someone has an issue with this I think that they ought to pursue it with MyxerTones. I'd rather see more open less restrictive APIs and don't think Flickr should change anything actually.

I think the approach of an open API but then disabling that API for those who violate the terms of the API is best. Flickr should be shutting down the MyxerTones API for their violation. The trouble is, historically they have shown that they don't want to police the violations, and as such give the impression that they don't care

Thomas, I think one of Jim's primary points was that when you sign up for Flickr, they make you agree to a terms of usage which spells out your rights. In addition, when you sign up to use their API, you agree to honor the usage restrictions assigned to each image. Since Flickr clearly knows that they are allowing API users to violate their agreement, I feel Flickr has some liability. Their remedy should be to plug the holes, which they are clearly not doing.

Tom, I disagree. Best I can tell MyxerTones turned the API off after realizing what very well could have been a legitimate mistake. I don't think Flickr ought to be the copyright police. I think this is better left between users and infringers.

As far as applications using the API to download and display images for personal use, I can't see how this would violate an all right reserved copyright any more than viewing them on on Flickr's web site. This certainly does not rob the copyright holder of any potential revenue, which would probably be the deciding factor if this were ruled upon in court.

I'm going to side with Brian here. What is right: Comet McNaught was that bright in WA (I use to live there), but I checked my attempted pics, they predate this by over a week. I'm sure the comet was only that bright for less than a week. Second, the main Australia Day fireworks occur in Perth City...which isn't near a beach . Maybe it's Leighton Beach with Fremantle to the left...but it doesn't seem right. I did check the weather records though, there was a storm that night, and it's in the right direction

Duncan, last year both Fremantle and I believe Hillarys held their own fireworks for Australia Day. I myself was trying to guess the location this morning. Being a regular on Leighton beach though it doesn't look familiar so I was thinking it may have been taken to the north of Hillarys. It also made me very nostalgic for Perth :)

Over the last month, I have tended to use Twitter less. During the last Lakers-Celtics game, for example, I was in the NBA Finals FriendFeed room. Ironic, since I spent good chunks of the World Series on Twitter.
