What I do know though is that most hosting companies, including the biggest ones have terms that state you can't even link to certain materials, even if linking to them isn't illegal. It's their servers, they can set whatever rules they want to on them. In your own house I'm pretty sure you can legally tell people to shut up or get out. They don't have to completely shut up, only in your house. This is digg's house so they can do what they want.
