As much as I hate almost anyone that uses a mic lately, there are the rare cases that I'm on a team where one or two (almost never more) people are legitimately using their mic. It would be way too much work to try to figure out who these potential people are if they were muted by default. What I do is take off my headset if a lobby is just too ridiculous. Then I wait until I'm in the game and mute people if it's still bad.
