Lynn Terry has a unique gift manifest in her ability to make complicated issues easy to understand provide guidance on the way forward. This issue will be interesting to watch as it relates to the that which was unintended - as often is the case when regulating business. I just hope no one goes overboard in their concern about the conduct of affiliate marketers. My best advice as when playing in Google's courtyard, play by the rules and stay off of the radar screen. It may require more work on your part, but it will be worth it! Informative post. - James Holmes

I have heard it say that the quality of your answers depends on the quality of the questions you ask. I have read a lot of interested blog comments and commentary in forums over the past couple of weeks. I appreciate your shining the light on the penalty question. I think as marketers we should certainly take the time to understand and play by the rules (just as with Google) allowing you to communicate to your market without landing in the sand box or taking a hit to your bank account. Michel - Consider this my non-paid endorsement that this blog post and comment stream should be mandatory reading for all affiliate product creators and affiliate marketers. As so often is the case with legislation, how is this going to be enforced (man power and budget) and what are the unintended consequences? It seems a bit of a challenging year for affiliate marketers with the State sales tax issues (in selected states) and the new endorsement rules as discussed, the landscape has certainly changed. My advice is to recognize that the sky is not falling; however, I become concerned by any threat to free markets and entrepreneurship in principle. Excellent post!
