Chris: if you use physical things to express something or have some kind of semantics, can they also be considered languages?

Certainly. Sculpture and other forms of physical artwork are protected as free speech. You may remember the uproar over the Robert Mapplethorpe's photography in the 80s, or Andres Serrano's controversial photography in the late 80s and early 90s.
