"This article examines the role of online media piracy in the shift away from acquisition- and ownership-based models of consumption in favor of access-based models. In this media industry climate, cloud technologies have played an increasingly important role in providing audiences with content on their own terms. Piracy has long served a similar function, but it is taking on aspects of cloud services as well. I investigate how cloud technologies are changing media piracy activities by examining cyberlockers, web-based services that afford consumers ubiquitous access and ownership of media content. "In the last two decades, the industry has endlessly deployed the rhetoric of the “digital threat” in order to demand harsher measures against digital piracy, peer-to-peer file sharing and the like. In fact, the uneasiness in sharing the view that harsher measures are an adequate response to copyright infringement in the digital environment comes from the uncertain grounds on which the heavy-handed reaction against digital piracy has been based. Two related arguments might run against this heavy-handed approach. First, market conditions might incentivize piracy. Additionally, there are raising doubts over the argument that piracy is a threat to creativity, especially in the digital environment. All in all, it may be hard to find a factual justification for policy decisions based on the “digital threat” discourse. "This article compares the development of the two central “piracy standards”—MP3 (sound) and DivX (audiovisual content)—analyzing the actors, strategies, and motivations involved in their inception and diffusion. Until recently, the main focus in the research literature investigating the relationships between commercialism and idealism in the development of the Internet has been on the clashes and confrontations between two supposedly incompatible worldviews. In accordance with newer approaches such as Castells and Cardoso’s (2012) and Lobato and Thomas’ (2012), we challenge this dichotomous and irreconcilable picture by investigating the borderlands and crossings between the two sides. As we argue, the cases of MP3 and DivX are strategic for beginning the exploration of these overlooked dynamics. The actor-network theory concepts of “displacement,” “translation,” and “immutable mobiles” are employed to trace the various phases in the propagation of the two standards.
