yes but there is one problem with this approach. You have had the same five or so sponsors for years now, podcast growth has stagnated, and therefore you are going to have diminishing returns because you are preaching to the choir about the same products we already have etc.

My understanding is that the law's constitutionality can then be challenged at the Supreme Court? It should never have to go that far, but at least it's not final.

It is a terrible example of intolerance. Makes me sad on a day I should be totally elated. Yes, we are finding another name for marriage between people of the same gender...but "seperate but equal" is still institutional prejudice.

Prop. 8 is a constitutional amendment. I don't think the courts can invalidate it.

Stephen: it was a state constitutional amendment. Why wouldn't the Fed courts be able to say "no way?"

Robert - I don't believe the Supreme Court will strike down the constitutional amendment. It's my gut. Researching, we have to find very solid CONSTITUTIONAL grounds to put down a state's right to ban a practice not protected by any portion of the Constitution. "Right to marriage" and "right to equality" are both not in there. Right to free speech, protest, and voting are, but possibly not this. States' Rights will trump.

Ben: well, then, this law will stand for a generation because it needs 2/3rds vote to overturn it and there's too much hatred of homosexuality to get 2/3rds. It will fall eventually but might need 40 years or more. Personally, I'd separate out the legal part of marriage (the legal contract you make with the state) from the religious part of marriage (the thing you do in church) and make a case that those rights should be equally open to all.

AJ: The courts can't overrule a constitutional amendment. The Supreme court can't overrule the U.S. constitution, same as Cali.

Scoble, I completely agree with you. The state has no business getting involved with a religious ceremony/status like "traditional marriage" and therefore shouldn't recognize it at all. Most married couples are non-religious anyway. So we should just ditch "marriage" for all couples and have a civil partner status for any couple that wishes. If they want to couple that with some kind of religious marriage, and if that is recognized by their church, is entirely inconsequential.

@Ben: I think you're right on the state level. But there is some precedent to the Federal courts invalidating state level amendments when they believe it violates the US Constitution, correct?

@Ben the Right for Women to vote wasn't in the constitution before either but we as a nation determined that women should be treated with equality and allowed to vote. Why should we deny a person the right to marry based on their sexual orentation? If this was simply about a religous determination and ceremony then it shouldn't involve the state, but now we are talking about legal marriage rights that heterosexual couples are currently entitled.

It's a standard press management political strategy. For reporters, access is power. The politician will take away your access if you are seen as overly critical. Once you do that a couple of times people will hesitate to write negative things for fear of losing their access.

Would have seemed more appropriate given its entire context. Palin (Like Lincoln, FDR, and Kennedy) believe God has a plan and believes in prayer to try to understand that plan. Don't know if I believe that myself, but it's a far cry from trying to cast this as a holy war.

I find it highly amusing to hear all the Palin supporters rant about Gibson's "out of context" question while McCain is running an ad that egregiously and deliberately misrepresents Obama's record on sex education.

The diffrence is that Gibson is a journalist and should know better. The McCain ad is a political attack ad. Pol ads distort and smear all the time. News should not. Otherwise people will stop watching. We also need to compare apples with apples. Obama - no foreign policy experience. McCain - tons of foreign policy experience. What's funny is that the media is comparing The pres candidate of one party with the Veep candidate of the other.

But I'm impressed with her very real track record of accomplishment and her shrewd political instincts.
