Even if they did own copyright people will hate them for screwing over Fairey. Especially when he made this work not out of a desire for money for himself but to donate to something he believed in. I highly doubt AP owns the rights as they apparently have no contract with Garcia. They should consider the PR outcome of this before continuing down this path.

+1000 ScottBourne I couldn't have said it better. The key to this case is whether or not enough transformation has been made to the original work. My take is that there is not enough transformation of the original work. It'll be interesting if this goes to court what they're take will be on the transformation issue.

possibly Fairey knew this all along and that's why he never claimed any ownership or copyright of the work. think about it. he's been around long enough.

I agree that this is a bad fight for AP to pick from a PR standpoint. But as an artist, I want to be able to control to whom I do or do not give my art. Thomas, this isn't a very different situation from your not wanting to give GQ free rights to your photo. Chris, Obama doesn't have to give rights to use his image. If the image was taken in a public setting, it's fair game.

While Obama may own rights to his own likeness, nobody owns rights to their own likeness when it comes to editorial usage. This is why model releases are not necessary for a newspaper or magazine to publish someone's image. Similarly fine art work has been upheld as also not requiring approval to use someone's likeness. despite both of these scenarios though, regarding Obama's rights to his image specifically, he was a presidential candidate and is now President of the United States. Political fair use is given perhaps the widest berth of all and it would be very hard to argue that any politician had rights to their image in a case like this.

Gregory in the GQ case I think it's just bad form for them to ask when they can pay. They certainly can try. But they are clearly looking for corporate profit. I don't think Fairey was looking for corporate profit around this image even if it added to his fame. I think he genuinely wanted to help the Obama Campaign, something he believed in. I think that in this particular case it is very unique and a very rare and different situation.

I'm not saying that the AP ought not be allowed to go after money here. I'm just saying that in light of the context and import of this image that it's probably very foolish from a PR perspective, especially given that it may turn out that they have no ownership of the original image to even start with.
